Trademark Objection Reply

Responding to an examination report that has objected to your trademark application.

Overview

What a trademark objection is

After a trademark is filed, the registry examines it and may raise objections — commonly that the mark lacks distinctiveness (Section 9) or is similar to an existing mark (Section 11). The applicant must reply within the prescribed time, or the application lapses.

The firm prepares a reasoned reply to the examination report, with supporting evidence and arguments, and represents the matter at a hearing where one is fixed.

Scope

What's included

  • Drafting a reasoned reply with evidence of distinctiveness or use
  • Distinguishing cited conflicting marks
  • Filing the reply within the deadline
  • Representation at the examination hearing, with a TM attorney where needed

FAQs

Frequently asked questions

  • My trademark has been objected — does that mean it's rejected?

No. An objection is the registry raising concerns; a well-drafted reply (and hearing if needed) can overcome it and let the application proceed.

  • How long do I have to reply?

Generally 30 days from the examination report. Missing it can cause the application to be abandoned, so a prompt reply matters.

  • How long does it take?

We prepare the reply quickly to meet the deadline; the registry's decision and any hearing then follow its timeline.
